TERMS & CONDITIONS
The Client unconditionally accepts the following terms and conditions.
DEFINITIONS
1. The ‘Owner/BEC’ is Bohemian Events Co.
2. The ‘Client’ refers to any individual, firm or corporation hiring equipment or that appoints services from the ‘Owner/BEC’.
3. The ‘Equipment’ refers to all hire items including furniture, homewares, lighting and accessories supplied to the ‘client’.
4. The ‘Event hire date’ is the day of the event supplied by the ‘client’ to ‘BEC’.
PAYMENT SCHEDULE
To offer security to the Client and BEC, initial non-refundable deposit of 25% of their invoice, receipt of which is hereby acknowledged, amounting upon execution of the Agreement, is required to be paid in order to confirm a booking. Quotes may be issued; however, requested hire items & services will not be confirmed until the deposit has been received.
The remaining balance is due no later than 24hours following to the date of Event. Overdue accounts will attract a fee of 2.5% of the outstanding balance per month. If the balance is not received within thirty (30) days of the balance due date, the Client shall be in default hereof and BEC may pursue any lawful remedies.
Additional charges for expenses, and additional services, may occur based on particular requests by the Client. Such charges will be reviewed with the Client prior to billing, except that when the charges involve unforeseen inflation in the cost of consumables/materials necessary to complete the scope of work. Payments can be made by cash or bank transfer to BEC.
DATE CHANGES
Should for any reason, the date of the event change, best efforts will be made by BEC to accommodate the new date. The Client agrees that in the events of an event change by the Client, any expenses including but not limited to deposits & fees that are non-refundable are the sole responsibility of the Client. Service changes can impact the quality of the event and that BEC is not responsible for any compromises on quality owing to such changes. If no suitable date is available to reschedule, the client will be offered a credit to spend on any BEC service (subject to availability) valid for one year from the original event date. This credit is not transferrable to any other party.
CANCELLATION POLICY
The Client may cancel a booking but may forfeit fees paid as follows:
(a) Bookings may be cancelled for free up to 8 weeks prior to the event date; BEC will make a full refund of the deposit and any additional payments to date.
(b) If booking is cancelled less than 8 weeks before the event, but more than 28 days prior, BEC will retain 100% of the deposit and any additional amounts already paid, but will offer the hirer a gift voucher to the value of their payments to date, valid for use on any service for 1 year.
(c) If booking is cancellation notice is given less than 14 days before the event date, BEC will retain 100% of the deposit and any additional fees already paid, and will not offer the hirer a gift voucher to that value; this is to recover the costs of potential bookings lost and for any labour and administrative costs incurred.
d) Cancellations of bookings/events due to weather shall still be subject to the cancellation policy above. BEC is in no way responsible for intemperate weather that may cause the client to cancel their booking. The Client will be offered the option to change the event location & alter the description of services to suit an indoor event.
e) If BEC is unable to provide services under this Agreement for reasons outside of its control; including but not limited to termination of the event by the Client, for any reason including bad weather conditions; force majeure; or government intervention, the Client will not be entitled to a refund of the initial deposit or any additional payments made to BEC under this Agreement.
f) For COVID19 related cancellations, a postponement option will be offered to the Client, subject to availability. If no suitable date is available to reschedule, the client will be offered a credit to spend on any BEC service (subject to availability) valid for one year, furthermore, the Client may request in writing to BEC transfer the credit to another party if they wish.
OWNERSHIP
The items supplied for hire remains at all times the property of BEC. The Client acknowledges responsibility for the hired items and is liable for any damages to these items in the specified hire period. The equipment shall not be used by anyone other than the Client, (for the event intended) without the expressed permission of BEC.
CONDITIONS OF HIRE
Hiring of the equipment will begin from the delivery or pick up date specified by BEC and shall be collected or returned. by the date specified by BEC. Any extension period must be agreed to by BEC otherwise additional fees will apply.
The Client agrees to operate, maintain and store the equipment strictly in accordance with any instruction provided by the owner, with due care and diligence, only for its intended use and in accordance with any manufacturer’s
instructions and recommendations whether supplied by the owner or posted on the equipment as to the operations, maintenance and storage thereof.
BEC has the right to refuse the hire of items in the event of extreme weather/temperatures forecasted and adequate protection has not been provided/pre-agreed to by the client. The owner shall determine via inspection, that the equipment is returned in appropriate condition and determine whether deposit shall be retained or refunded.
The Client shall ensure the equipment is returned to the owner damage free, clean of soil or any other foreign matter.
In the event that these requirements are not complied with the hirer shall forfeit their deposit to the owner, to cover the reasonable costs of compliance with these requirements. Any charges incurred by BEC or their agent/s, in recovering equipment and/or monies will be charged additionally to the client. BEC may retake possession of the equipment if the hirer breaches any provision of this agreement. If repossession takes place, BEC shall only charge the hire fee up to and including the time of repossession.
DELIVERY, COLLECTION AND SET UP
If delivery is required, a minimum of $200 (ex delivery charges) must be spent on hired items for events held in Perth Metro areas; some areas of Regional & SouthWest WA may also be eligible for delivery depending on location; minimum hire spend for these areas is $1500. Delivery fee will be quoted based on location and travel time. Delivery fees and additional expenses related to travel are quoted separately to the hire amount and deposit.
Unless a setup fee has been charged and agreed upon by BEC, the Client is responsible for the setup of equipment (DIY). There is no minimum hire spend if the client requires a DIY service (meaning the client collects and returns hire items from/to BEC). It is the client's reponsibility to ensure they have arranged adequate transport for DIY bookings. The Client indemnifies BEC from any and all liability for any injuries or accidents that may occur as a result of DIY hire.
Hire item prices do not include delivery, collection, additional labour or transport unless specified by the hire company.
The delivery and installation fees vary depending on the location of the event and the actual order. This fee may be subject to change should the client alter the order, location of the event or amount of equipment to be setup. Should extra labour be required under any circumstances, then additional charges will apply.
BEC will contact the client, prior to the delivery to confirm the Client of the delivery time. The hire company requires flexibility around delivery and collection, at any time given allow a two-hour window for unforeseen circumstances such as traffic accidents. Standard delivery fees apply to deliveries and collections that occur between 7am and 7pm Monday to Sunday. The Client will incur an additional fee for any urgent out-of-hours, time-limited or Public Holiday deliveries and collections.
The Client agrees to ensure that any site specified on the hire agreement, will be clear of obstructions to allow BEC. to erect, install or place the hire equipment safely. The hire company must be informed of the location of all water, gas, reticulation pipes and telephone cables prior to installation. Whilst all care will be taken, BEC will not be held responsible for any damage to water, gas, electricity and telephone cables or property. Any repairs will be at the Client’s expense.
DAMAGE, LOST, STOLEN OR UNCLEAN EQUIPMENT
The Client is responsible for the hired items during the hire period. Any lost, stolen, damaged or breakage of equipment, however caused during that period, will be paid for by the client; whereby BEC will retain the security deposit as payment for costs incurred. If an item is returned and deemed damaged but repairable (by BEC), the Client will be charged for the cost of repairs.
All equipment is to be returned to BEC in a clean but not necessarily sterile state (glassware is to be rinsed at minimum and any stains of spillages must be attempted to be cleaned), unless otherwise specified. Returned equipment that requires further cleaning will incur an additional charge, deductible from the security bond.
In the event any hire items are not returned to Bohemian Events Co. by the specified time and date, the hire company may retain the deposit at their discretion. Where the client is not eligible for a refund of their deposit, even if
returned, this is considered loss of opportunity whereby the hire company may have had to forfeit other bookings.
The client shall protect the equipment from the elements during the time of hire. In poor weather conditions storage of the equipment may be necessary and is the responsibility of the client to see that the equipment is stored safely. Any equipment damaged from the weather is the full responsibility of the client and shall be paid by 100% forfeit of the
deposit.
All costs associated with any lost, stolen, damaged or unclean equipment, will automatically be deducted from the security deposit amount in the final invoice and retained by the BEC. If the costs exceed this amount, BEC will contact the Client within 7days to discuss payments options. The matter will be escalated to a debt collection agency if the Client does not make a reasonable attempt to repay the costs.
INSURANCE AND INDEMNITY
Hire equipment is insured during the hire period, however all responsibility lies with the Client.
The Client hereby indemnifies and holds indemnified Bohemian Events Co., its agents and employees, from and against
all claims, actions, demands and expenses in any way arising from injury, death, loss of income or damage caused to
the client or its property or the associated users in respect of the equipment or these terms.
